SuperMedia LLC ("SuperMedia") respects your right to privacy, and we want you to be aware of how we collect and handle information through this website.

This Privacy Policy applies only to the user privacy of the www.supertradeexchange.com website ("This Website"). It does not apply to the offline activities or other websites of SuperMedia LLC or any of its affiliates. By accessing and using This Website you agree to be bound by this Privacy Policy and expressly consent to our use and disclosure of your personal information in accordance with this Privacy Policy. You may not use or access This Website if you do not agree to this Privacy Policy. This Privacy Policy is incorporated into and subject to the SuperTradeExchange® Member Agreement (the "Member Agreement") and all terms defined in the Member Agreement, including the SuperTradeExchange® Marketplace Rules, will have the same meaning when used in this Privacy Policy.

2. Overview

This Privacy Policy is effective as of April 22, 2010. Our business changes constantly. This Privacy Policy will change also, and information collected through This Website is subject to the Privacy Policy in effect at the time the information is collected (unless you consent otherwise as to information related to you). You are advised to check this web page (or such other page accessible by clicking on the Privacy Policy link in the footer of This Website) frequently to see recent changes. SuperMedia will notify users of any changes to this Privacy Policy by posting the version of the Privacy Policy containing such changes on this web page (or such other page accessible by clicking on the Privacy Policy link in the footer of This Website).
This Privacy Policy describes the information, as part of the normal operation of our services relating to This Website, we collect from you and what may happen to that information. You acknowledge and agree that any actions or obligations that we may take or have under this Privacy Policy may be performed by third parties we contract with. These third parties are prohibited from using your personally identifiable information for any other purpose including their own marketing services.

3. The Information We Collect

You can visit portions of This Website at any time without providing any information about yourself (except as described under "Personal Information Collected by Browser," below). However, in order to use certain portions of This Website, you will need to provide some personally identifiable information, as further described below. You are responsible for the accuracy and completeness of all information you knowingly provide to This Website.

Accounts. To use our services, such as searching the SuperTradeExchange® service, creating web pages, viewing web pages, uploading information, buying and selling products and/or services, etc., you will need to register and create an Account with us. To create such an Account, you will be asked to provide certain personally identifiable information, such as your name, address, telephone number, e-mail address, and web address ("Exchange Information"). In connection with your payment arrangements you also may be required to give us credit card numbers and expiration dates and bank account name, account number and location ("your financial information") and your taxpayer identification number. When you create an Account, we will provide you with a User ID name and password. If you do provide SuperMedia with personally identifiable information, we will take reasonable steps to protect this information. We also urge you to keep your password confidential and refrain from sharing it with others. We will not disclose your financial information to any other company or Member of the SuperTradeExchange®, except to credit card processing companies, other third parties we contract with, and banks to process payments from you. We will never divulge your taxpayer identification number, except as required by law or to third parties we contract with to provide all or part of our services. You acknowledge and agree that your Exchange Information will be available to the general public accessing This Website.

Communication Tracking. Any time you contact us, we may keep a record of that communication. This applies to any method of communication including the content of telephone calls, e-mails and letters. The records we maintain will also include any transactions you have entered into with Members or other authorized parties and may include comments from persons or entities that have transacted with you. This information may be used to help resolve disputes with our own accounting department or with another Member or authorized party. We may also ask your opinion of services which we offer or plan to offer to analyze our performance or opportunities.

Personal Information Collected by Browser. As you (and other users) browse This Website, our web servers automatically collect certain types of information about such visits (usually through the use of cookies, JavaScript tags, clear .gif files also known as "web beacons" and the analysis of http headers). Such information may include the user's IP address, domain name, browser type, and user agent, the page(s) the user visits and for how long, the date and time a user accesses This Website, the Internet address of the site from which the user directly linked to This Website and the links on This Website on which the user clicks. We also may collect certain search parameters relating to searches conducted by the user which are not entered by the user. We only use this data in aggregate form, that is, as a statistical measure, and not in a manner that would identify you personally. This type of aggregate data enables us to determine how often Members use parts of This Website or services so that we can make This Website appealing to as many Members as possible and improve those services. As part of this use of information, we may provide aggregate information to our partners about how our Members, collectively, use This Website. We share this type of statistical data so that our partners also understand how often people use their services and This Website, so that they, too, may provide you with an optimal online experience.

In some cases, we may also collect non-personally identifiable information that you provide, such as search parameters in connection with a search you conduct through This Website, ratings and reviews, and zip code.

Transaction tracking.We maintain records of every sale, purchase and transfer into or out of your Account. We also maintain records of each fee charged to you whether it is in U.S. currency or SuperBucks™.

4. The Way We Use Information Collected from This Website

We use personally identifiable information to operate This Website and to facilitate the transactions and any services available through it that you request, to inform you of other services or offers in which you might be interested, and to improve and enhance This Website. We use your personally identifiable information in the file we maintain about you, and other information we obtain from your current and past activities on This Website, to: resolve disputes; troubleshoot problems; help promote transactional integrity; collect fees owed; measure interest in our products and services, inform you about online and offline offers, products, services, and updates and otherwise communicate with you; customize your experience; detect and protect us against error, fraud and other criminal activity; enforce our Member Agreement; and as otherwise described to you at the time of collection. However, you may request not to receive ("opt out" of receiving) commercial e-mail messages (the primary purpose of which is the commercial advertisement or promotion of a commercial product or service) from us, on a category-by-category basis, by replying to one of our commercial e-mail messages with the word "Unsubscribe" in the subject line.

At times, we may look across multiple users to identify problems or resolve disputes, and in particular we may examine your personal information to identify users using multiple User IDs or aliases. We may compare and review your personal information for errors, omissions and for accuracy.

We will provide your Exchange Information to other Members or parties permitted to trade on the SuperTradeExchange® website so that they may contact you to solicit your business and to obtain products and/or services from your business. We may solicit Members and parties permitted to trade on the SuperTradeExchange® website on your behalf and will inform them how they may contact you.

If you choose to transact business on This Website or open a credit account, or otherwise provide us with your financial information, we use your address and billing information to bill you and provide associated support. We do not share information concerning your credit card numbers and expiration dates and bank account names and account numbers with outside parties except credit card processing companies, third parties we contract with, and banks to process payments from you.

You agree that we may use personal information about you to improve our marketing and promotional efforts, to analyze usage of This Website, improve our content and product offerings, and customize This Website's content, layout, and services. These uses improve This Website and better tailor it to meet your needs, so as to provide you with a smooth, efficient, safe and customized experience while using This Website.

We reserve the right to send certain types of e-mail messages that are not subject to op-out (see information about E-mails, below) to online users, including those who have opted out of receiving commercial e-mail messages.

Information that you provide to us on This Website will be retained in accordance with SuperMedia’s Records Management and Retention Policy and applicable laws.

5. Sharing and Disclosing Information

We may disclose your personally identifiable information to anyone outside the "SuperMedia Family" under the following circumstances: (a) we have been given your consent to disclose; (b) we have previously informed you of the disclosure; (c) it is required by law or we believe that disclosure is necessary to confirm to the edicts of the law; (d) we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order or legal process served; (e) we believe that disclosure is necessary to identify, contact, or bring legal action against, someone who may cause or be causing harm to, or interference with, our rights or property, other users of This Website, or anyone else;(f) it is to complete a transaction, service, or activity that you initiated or requested; (g) it is to third parties we contract with to provide services in connection with This Website; or (h) SuperMedia transfers all or substantially all of its assets to another entity (in which case SuperMedia may disclose, sell and/or otherwise provide personally identifiable information to such entity). We may also use IP addresses in cooperation with your Internet service provider to identify users if we deem it necessary to enforce compliance with this Privacy Policy or to protect This Website, our customers or others. You consent to the disclosure to and use by a subsequent owner or operator of This Website of any and all information about you contained in the applicable Website database, if we assign our rights and obligations in connection with This Website or is otherwise acquired via merger, acquisition, or sale of all or substantially all of our assets to a subsequent owner or operator. In any such event, you acknowledge that the use and storage or your personal information will be governed by the privacy policy of This Website's subsequent owner or operator. In addition to the other disclosures permitted under this Privacy Policy (including personally identifiable information) from time to time, SuperMedia may share with third parties aggregate, non-personally identifiable user information to show general demographic and preference information among users of This Website.

Strategic alliances. From time to time we may enter into alliances with other companies to market products or services not currently being offered by SuperMedia. In connection with such alliances, we may furnish your Exchange Information to others so that they may send you information on the products and services they have contracted with us to provide. We will not furnish any financial information to such alliances without your consent. Members may opt out and elect not to allow any information to be shared with our strategic alliances by calling 1-866-988-TRADE, but you may not opt out of the information being provided to other Members, other parties permitted to trade on SuperTradeExchange®, brokers, or our employees.

Cooperation with police authorities and lawful orders of the courts. We will cooperate with any investigation with any jurisdiction's police authorities in their investigation of the utilization of SuperTradeExchange® for criminal activities and will comply with any subpoena or court order requiring the turnover of Member information that we believe is necessary to protect SuperMedia from liability.

Sharing information we automatically collect through This Website. SuperMedia may share information it automatically collects through This Website with non-"SuperMedia Family" companies in order to assess the results of a promotion, event or third party relationship, to provide information to current or prospective Members, to complete a transaction, service or other activity that the user initiates, or to otherwise enhance your online experience. When we use third party tracking services to help us analyze automatically collected information in the aggregate to evaluate the effectiveness of This Website, the third parties performing such tracking services are not permitted to use the information for any other purpose.

We may also disclose information SuperMedia automatically collects to non-"SuperMedia Family" companies or entities if (a) it is required by law or we believe that disclosure is necessary to confirm to the edicts of the law; (b) we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order or legal process served; (c) we believe that disclosure is necessary to protect the safety of customers, employees or property; or (d) SuperMedia transfers all or substantially all of its assets to another entity (in which case SuperMedia may disclose, sell and/or otherwise provide personally identifiable information to such entity).

6. Our Commitment to Data Security

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place physical, electronic, and managerial procedures to safeguard and secure the information we collect online or information you provide directly to us. Your Account personal information is protected by a password for your privacy and security. While we take precautions against possible security breaches of This Website, no web site or Internet transmission or connection is completely secure. Consequently, we cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur--and your use of This Website is at your own risk. We urge you to keep your personally identifiable information safe by (i) memorizing your password or keeping it in a safe place, separate from your Account information, (ii) logging out of your Account, and (iii) closing your web browser. Unless otherwise specified herein or on This Website, credit card numbers and bank account numbers are used only for payment processing and are not retained for marketing or any other purposes. We are committed to safeguarding customer privacy on This Website. SuperMedia may send you commercial e-mail messages (unless you have chosen to opt-out of receiving them, with some exceptions, as explained below) and non-commercial e-mail messages (which are not subject to opt-out, as explained below). 9. Cookies

A cookie is a small data string our server writes to your hard drive that contains your unique User ID for This Website. Cookies help us to identify new and returning users to This Website, analyze click-stream data, and track historical activity on This Website, which allows us to give you a more personalized, useful experience on This Website. Cookies may be placed on This Website by us or by a third-party that provides services to us.

Cookies help SuperMedia to enhance the user's online experience and can be used to:

However, you need to understand that some websites/ad serving companies have the ability to reestablish your history even after cookie deletion, if you reenter the same site on another occasion, or some other site tracked by the ad serving company/network, and specifically provide personal data.

Deletion of cookies alone does not prevent ad serving companies from reestablishing history on a user. The user must either continue to decline cookies each time it reenters the site to keep the tracking severed, if desired, or opt-out. 10. Our Commitment to Children's Privacy

SuperMedia does not knowingly collect personal information from children through This Website. SuperMedia does not request that users provide any personal information through any area of This Website that is directed towards children. SuperMedia may, however, automatically collect certain information regarding users' visits to This Website (for example, the user's IP address, the user's domain name, the user's user agent, which pages the user visits and for how long, the date and time the user accessed This Website and the referral URL) including areas of This Website, if any, that are directed towards children. SuperMedia asks parents or legal guardians to assist SuperMedia by supervising any activities of children at This Website.
